The reasons for divorce between a couple are simply too many to count. It is usually a preference that the two settle their differences instead of going to the court. Another reason why the courts would want the marriage to stay intact is because it is a legal entity. However, despite everyone wishing that a marriage will not fall out it almost seems inevitable especially in the recent times.
A fault divorce refers to a divorce that the grounds for the request of divorce are that it's the fault of one of the partners. No matter what the couple tries to do they seem not to be able to get over that problem and so see divorce as the only way that they can each have their peace back. A good example would be where one partner happens to cheat on the other and that partner cannot seem to forgive his partner thus they have to part ways. A fault divorce is totally the opposite of a no fault divorce. A no fault divorce is whereby the couple is in agreement that the marriage is not working and they need to part ways. No partner has to have done anything wrong; it's only that they think that it would be best for them if they parted ways. This type of divorce is also known as uncontested divorce.
The list of things that can lead to a fault divorce is very long. One of the most common reasons for this divorce is the cruelty of one person. Cruelty leads to one of the partners experiencing pain. This pain is not limited to physical pain brought about by abuse but also emotional pain. This cruelty can be brought about by constant yelling, verbal abuse, name calling and so many others.
As we had said earlier another thing that can lead to a fault divorce would be unfaithfulness. However, unfaithfulness cannot always be constituted as a reason for a fault divorce. This happens when one of the partners knows that the other partner is cheating on them and does nothing about it. The fault divorce will not stand as the partner will be assumed to have been condoning the affair. So if you are experiencing such a situation it would be advisable to get to know what to do.
Another factor that can lead to a fault divorce would be abandonment. This refers to a situation where one of the partners leaves the house and goes to live somewhere else. It does not matter if he or she goes to live alone or with another person, as long as the person has deserted their partner it will be termed as desertion. It can also qualify to be called desertion when one of the partners is put behind bars for a number of years.
The reason why people struggle for it to be termed as a fault divorce is because the partner filing it will receive a bigger settlement.
